face of Employment Practices Liability Insurance (EPLI) is ever
changing. While most businesses will never have to use their coverage,
some recent court rulings have made this coverage more essential
than ever.
The
Supreme Court recently ruled that employees can now sue over policies
and practices that have a "disparate impact" on older
employees without having to prove that the discrimination was intentional.
This recent judgment applies to workers as young as 40 years of
age. It's important to note, if reasonable factors other than age
account for the disparate impact, the policies will not be found
unlawful.
What
does this mean for you? Perhaps nothing, but it is a good idea to
assess your risks. Insurance coverage can be costly, but much less
expensive than the cost of defense and damages without any coverage.

A suit filed in Connecticut, on behalf of 8 Connecticut residents

What
role did some of the defendents play? Purely peripheral ones - a
radio station gave away tickets to the concert, a music store sold
a couple tickets, Anheuser Busch sold beer, and a tv cameraman was
shooting footage of the concert. The lawsuit has named anyone with
a remote connection in order to better its chances for settlement.
This is also known as looking for the "deep pockets."
